These Terms & Conditions ("Terms") govern your access to and use of the website operated by Ground Up Outdoors ("Company," "we," "our," or "us") at groundupoutdoors.com, and any landscaping, design, irrigation, tree care, or grounds maintenance services we provide in Southern California. By using our website or requesting our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing this website, requesting an estimate, or engaging Ground Up Outdoors for any service, you confirm that you are at least 18 years of age and have the legal authority to enter into a binding agreement. If you do not agree with any part of these Terms, you must discontinue use of the website and decline our services.
2. Use of the Website
You agree to use this website only for lawful purposes. You may not:
- Use the website in any way that violates federal, state, or local law.
- Attempt to gain unauthorized access to any portion of the website, our servers, or any connected systems.
- Use any automated means (bots, scrapers, harvesters) to extract data without our prior written consent.
- Interfere with or disrupt the operation of the website or impose an unreasonable load on our infrastructure.
- Submit false, misleading, or fraudulent information through any form on this website.
3. Intellectual Property

4. Services and Estimates
Estimates provided by Ground Up Outdoors are free of charge and carry no obligation. Estimates are based on a site visit, our professional judgment, and the information you provide. An estimate is valid for thirty (30) days from the date of issue unless otherwise stated in writing. Final scope, pricing, and timing are governed by the signed service agreement or proposal, not by these Terms or any information on this website.
We reserve the right to revise an estimate if the actual site conditions, project scope, materials, or access differ materially from those represented at the time the estimate was prepared. Any change in scope will be documented in writing before additional work proceeds.
5. Payments and Pricing
Payment terms for each project are set out in the signed service agreement or proposal. Unless otherwise agreed in writing, payment is due on completion of the work or in accordance with the milestone schedule in the proposal. We accept the payment methods listed in your agreement. Past-due balances may accrue interest at the maximum rate permitted by California law and may be referred to a collection agency. You agree to reimburse us for reasonable costs of collection, including attorneys' fees, where permitted by law.
6. Cancellation and Rescheduling
You may cancel or reschedule a project before work has commenced by giving us at least seventy-two (72) hours' notice. Cancellations made with less notice may be subject to a fee equal to documented out-of-pocket costs (such as restocking charges on perishable plant material, equipment mobilization, or scheduled crew time). If we cancel or reschedule because of weather, supplier delays, or other circumstances beyond our reasonable control, we will reschedule the work at the earliest available date at no additional charge.
7. Warranties and Limitation of Liability
We warrant that our work will be performed in a workmanlike manner consistent with industry standards for landscape contractors in Southern California. Specific warranties on installed plant material, irrigation components, and hardscape elements are set out in your service agreement. Living plant material is warranted only to the extent expressly stated in writing.
Except for the limited warranties described above, this website and our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by California law, Ground Up Outdoors's total liability arising out of or relating to any project, service, or use of this website shall not exceed the amount paid by you for the specific service that gave rise to the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including lost profits, loss of use, or loss of data.
8. Property Access and Site Conditions
You are responsible for granting safe and lawful access to the property where work will be performed, for disclosing the location of underground utilities and irrigation lines, and for obtaining any homeowner's association, municipal, or other approvals required before work begins. Ground Up Outdoors will call DigAlert (811) before digging where required by California law. We are not responsible for damage to unmarked or improperly located private utilities, irrigation lines, or buried structures that were not disclosed to us in writing.
9. Indemnification
You agree to indemnify, defend, and hold harmless Ground Up Outdoors, its officers, employees, crews, subcontractors, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) any inaccurate or incomplete information you provided concerning the project site, property boundaries, or underground utilities.
10. Third-Party Links
Our website may contain links to third-party websites or services that are not owned or controlled by Ground Up Outdoors. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. You access these links at your own risk.
11. Privacy
Your use of our website is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the website, you consent to the practices described in the Privacy Policy.
12. Modifications to These Terms
